Mark McCloskey, 63, and his wife Patricia, 61, are being investigated after they were filmed on their lawn in St Louis, Missouri, with their weapons pointed at demonstrators on Sunday.
St Louis Circuit Attorney Kim Gardner is looking into whether the couple broke the law, RiverFront news reported .
She said in a statement: ‘Make no mistake: we will not tolerate the use of force against those exercising their First Amendment rights, and will use the full power of Missouri law to hold people accountable.’
St Louis Metropolitan Police are also investigating the incident.
Mr McCloskey told KMOV-TV: ‘This is all private property. There are no public sidewalks or public streets.
‘We were told that we would be killed, our home burned and our dog killed. We were all alone facing an angry mob.’
Protesters were marching towards the home of St Louis Mayor Lyda Krewson, following a statement she had delivered during a Facebook live on Friday where she had identified members of the public who had written letters to the City Hall calling for police reform.

In a video posted to social media, peaceful protesters walking past the armed couple, looked on in astonishment as they were ordered by the couple to stay away from the home.
Several protesters could be seen urging others to keep walking in a bid to keep the situation contained.
US President Donald Trump retweeted the ABC News video of the confrontation a day after being forced to delete another video that showed one of his supporters shouting ‘white power’.
The White House said he had not heard the ‘white power’ shout before posting the footage.
